SMARTCOACH™ Terms of Service

Acceptance of Terms
Use of Smart Coach™ (the “Service”) is governed by these Terms of Service (“Terms”). By accessing or using the Service, you agree to these Terms.

License
Smart Coach™ grants you a limited, non-exclusive, non-transferable license to use the Service for your internal program operations.

Usage Restrictions – You may not:

• Reverse engineer or otherwise attempt to gain access to source code

• Use automated systems to extract data

• Distribute or sell the Service

Intellectual Property
Smart Coach™ retains all rights, title, and interest in the software, trademarks, and content. You retain copyright to your own uploaded materials.

Data and Privacy
Subject to the Privacy Policy, you own the rights to your data. Smart Coach™ may use anonymized data for product improvement.

Term and Termination
Either party may terminate this license. Upon termination, your access will be revoked, and stored data deleted per the Privacy Policy, unless legally required to retain.

Warranties and Disclaimers
The Service is provided “as-is” with no express warranties. Smart Coach™ disclaims all implied warranties to the fullest extent permitted.

Limitation of Liability
Smart Coach™ will not be liable for indirect, incidental, or consequential damages. Total liability is limited to the amount paid in the prior 12 months.

License
Smart Coach™ is licensed, not sold. You are granted a non-transferable, limited-use license to access features under your subscription plan.

Payment and Subscriptions
Smart Coach™ uses Stripe for secure payment processing. Access to premium features requires an active subscription.

Disclaimer
Smart Coach™ is provided “as is.” We are not liable for data loss or service interruptions.

Termination
Access may be suspended for non-payment, policy violation, or misuse.

Governing Law
These Terms are governed by the laws of Nova Scotia, Canada.
